The Demise of the 28-Article Ceasefire Plan for Ukraine: Why Diplomatic Efforts Continue to Stumble

Europe breathed a deep collective sigh of relief on Monday, as the crisis caused by the announcement of a new 28-point plan for achieving ceasefire appeared – temporarily – to have been defused. A American diplomat spoke of "notable headway" after bilateral negotiations in Geneva. On Monday night, Moscow made its countermove: a renewed assault of rocket attacks on Kyiv.

The Rhythm of Diplomacy and Destruction

The chain of contrasting events captured the bleak nature of the outgoing year. By day, negotiation efforts are waged: hopeful statements are issued from different nations. Considerable effort is expended on containing certain initiatives. By night, Moscow brutally reminds the world that, for them, conflict continues to be the key method for achieving "settlement".

Nocturnal Warfare

As military strikes unfolded into the early hours of Tuesday, the immediate reality of Ukraine's defenselessness was revealed. Ukraine is equipped to monitor projectile deployments from across the border, a capability enabled by current data. From observation points, military aircraft that had been deployed to intercept incoming guided weapons streaked across the sky – sophisticated military planes delivered to Ukraine by NATO members.

Moments later, Kyiv's air-defence systems engaged: multiple launches fired to intercept a hostile projectile. This was a sophisticated defense system at work, most likely provided by Western nations. Every firing creates sudden vibrations, causing tremors. The moment of terror quickly becomes sober acceptance: perhaps the incoming missile won't hit its mark this time, protecting urban areas from devastation and another blackout.

Persistent Threats

Following this, a large-caliber weapon fired at a drone close by, part of a mobile-fire group – most likely imported technology. Sadly, the shots failed to hit the enemy aircraft – it continued its flight toward its target.

Intermittently, this persisted until dawn. Kyiv greeted the early updates: multiple fatalities, damage and heating outages in numerous residences as a result of the nocturnal offensive. As typically, everyone still maintained normal activities – experiencing conflict. But those 24 hours demonstrated Ukraine's essential dependence on Western support – a reliance that neighboring countries are evidently unprepared to fill in the near term.

Failed Diplomacy

The 28-point plan from Washington provoked deep reactions, controversy and deep concern – and temporarily diverted attention from Ukraine's major integrity crisis in years. Yet, we have experienced comparable situations, after earlier high-level meetings and bilateral conferences.

Every new approach from American administration follows the same pattern: a negotiation push against Ukraine, which Kyiv, with other European capitals, succeeds in resisting. They manage the tension but never actually achieve victory. This cycle will, no doubt, endure.

Strategic Calculations

It is tempting to accuse specific actors of persistently promoting Russian terms. But that does not seem to be the complete picture. US administration operates on a principle familiar among seasoned negotiators: you cannot win at the negotiating table what you have been unable to protect through force. The US administration assumes that it is unrealistic to pressure the Kremlin to abandon the land that it currently occupies in Ukraine's occupied territories.

The problem is that while recognising this factual reality, Washington does little to deter Moscow, through diplomacy or military means, from assuming that the status quo will not shift further in its advantage in the near future.

Conflicting Perspectives

Therefore, Moscow is confident that duration works to their advantage – that Ukraine and its allies are nearing depletion. Their motivation to sign a deal that does not give them the maximum possible gain is close to zero. There may be numerous efforts to stop fighting, but they will carry on as long as Russia's government remains supremely confident in the outcome.

On the contrary, Ukrainian leadership believes that Ukraine can still hold out, slowly losing civilians and areas but averting a total frontline collapse until circumstances change in its favour.

Current Realities

Realistically, there are no actual prerequisites for a armistice. Now, personal considerations are entering the equation: personal goals to broker a ceasefire and obtain worldwide acknowledgment, and Ukrainian leadership's dual difficulties – on one hand, not to distance important partners, and on the other, to unite the population around the national cause against any initiative Kyiv finds unsuitable, so that their attention does not shift toward internal issues. And although their mission will now be considerably more difficult after current events, it remains quite doubtful that this will alter their fundamental strategy.

These conflicting dynamics are guiding negotiations.

Conclusion and Outlook

It took a just a single week to eliminate the suggested clauses of the latest plan. Aggressive and erratic handling of the matter by American leadership, pushback by Ukraine and the rest of Europe, along with calming attempts of diplomats, and finally, recent disclosures, all served their function.

While new plans based on old ideas are imminent, Kyiv, London and other European capitals should reach an essential realization: Ukraine and Europe will only be able to resist diplomatic offensives from Washington that are based on Russian demands and show specific hesitation to alter the situation, if they maintain solidarity and enhance their military capacity at a much faster pace. If they do, no combination of diplomatic or military actions will be able to overcome them. In the meantime, Ukraine's ability to counter nocturnal attacks will, for the predictable period, largely rely on ongoing international assistance.
